How your BAC can affect DUI charges in AZ

Unfortunately, there are many people who get pulled over or get into an accident because they are extremely intoxicated. These situations can be among the most severe for people facing DUI charges because Arizona laws can be particularly harsh on very drunk drivers.

There are basically three different levels of driving under the influence. The first level is what we discussed in the above-mentioned blog post and includes drivers with blood alcohol concentrations over the legal limit of 0.08 percent. People in this category may not even realize they are too intoxicated to get behind the wheel.

The second level is referred to as Extreme DUI and addresses people with a BAC between 0.15 percent and 0.20 percent. In accordance with Arizona DUI laws, people convicted of this offense could be sentenced to 30 days in jail and will be subject to fines and assessment costs. Community service may also be required.

The third level includes the most significantly impaired drivers and is called Super Extreme DUI. Drivers who have a BAC of 0.20 or above can be charged with this offense and be faced with longer jail sentences, higher fines and the potential for lengthy suspensions or revocation of a license.

As a driver's BAC increases, so too do the penalties of a conviction. Considering how important this number can be when it comes to charges, it can be crucial to ensure police procedures and testing equipment were all accurate when a person was arrested.
