When Are DUI/DWIs Charged As Felonies?

There are four circumstances in which DUI/DWIs will be charged as felony offenses:

  1. If you've had two prior DUI/DWI convictions in the past seven years
  2. If you are charged with DUI/DWI while driving on a suspended, revoked or restricted license
  3. If you have an interlock ignition device in your vehicle
  4. If you were driving drunk with children under the age of 15 in the car

The first three circumstances will result in Class 4 felony charges. If convicted, you face:

  • Over 10 years in prison, with a minimum mandatory four-month sentence
  • Fines up to $150,000
  • Revocation of your driver's license for three years
  • Up to 10 years of probation
  • Confiscation of your vehicle
  • Orders to complete alcohol treatment

DUI/DWI with children in the car is a Class 6 felony. The penalties for a conviction are similar to Class 4 felonies, with a few exceptions: jail sentences are capped at six months with a mandatory minimum 10-day sentence, and your license revocation will last up to one year.
